Controversial tender for purchase of 25 trams reactivated – Request for protection of rights rejected

The plot twists regarding the tender of GSP Beograd for the purchase of 25 trams for the needs of this company, the biggest public transporter in Belgrade, continue. Less than two weeks after this public procurement procedure was reactivated and quickly stopped again due to the submitted request for the protection of rights, the tender is now officially reactivated again.

The condition for the reactivation of this twice-suspended public procurement procedure is met as the Republic Commission for the Protection of Rights in Public Procurement Procedures has rejected the latest request for the protection of rights. As can be seen, it was filed by the Polish company PESA, but after considering it, the commission rejected it for formal, and not essential, reasons. In other words, the request was rejected because it was determined that the formal conditions when it comes to the manner of submitting such requests were not met. And when it comes to essential matters, it’s not that PESA did not have concrete complaints about the tender itself and its conditions. As can be seen, the complaints made by that company are more or less the same as those that other potential bidders pointed to in the large number of questions asked about this public procurement procedure. The complaints of the potential bidders, let us remind, had to do with the short deadlines, both for the submission of bids and for the delivery of the vehicles. A part of the complaints regarding this tender that the potential bidders made also pertain to the requested weight of the vehicle, the door width, the number of rail trucks, which some bidders consider potential discriminatory stipulations which limit the competition.


After this rejection of the request for the protection of rights, the deadline for the submission of bids for the tender for the procurement of 25 new trams has been extended until June 10.
