The Parliament repealed the Law on Projects of special importance for Serbia - In the future, the construction of subways and highways without an accelerated procedure

The Parliament of Serbia has adopted the Law on the Termination of the Law on Special Procedures for the Implementation of Projects for the Construction and Reconstruction of Line Infrastructure Facilities of Special Importance for the Republic of Serbia, proposed at the end of 2019. By the Decree of the President of the Republic, adopted on July 27, this lex specialis officially ceased to be valid.

Projects that have already been commenced under this Law will be continued in accordance with its provisions.

The reason for the cancellation, according to all available data, is the provision on the selection of a strategic partner, that is, the non-application of the Law on Public Procurement, which was repeatedly pointed out by representatives of the European Commission.

- Bearing in mind that the European Commission has repeatedly, both in writing and in direct meetings, drawn the attention of the Republic of Serbia to the fact that the provisions of the Law on Special Procedures for the Implementation of Projects for the Construction and Reconstruction of Line Infrastructure Facilities of Special Importance for the Republic of Serbia are not in accordance with the legal assets of the European Union, especially in the part related to public procurement and the selection of the so-called strategic partner, a decision was made at the Government level to repeal this law - the earlier statement reads.

In late 2019, the Government of Serbia adopted a proposal for a special law in order to, as stated at the time, speed up the construction of important infrastructure projects such as the subway and highways, shorten the time for resolving property legal relations and avoid possible penalties for not withdrawing money from banks.

The draft Law on Special Procedures for the Implementation of Projects for the Construction and Reconstruction of Line Infrastructure Facilities of Special Importance for the Republic of Serbia, provided that projects of special importance for the Republic of Serbia, "projects of construction and reconstruction of line infrastructure facilities that affect the overall development of the Republic of Serbia, are evenly regional and local economic development, international, regional and internal territorial connection, prevention of devastation of parts of the territory of the Republic of Serbia, provision and improvement of the basic life needs of the population, social development and environmental protection, thereby improving the overall standard of living of the citizens of the Republic of Serbia."
